G. Stuart Hamm was Albemarle County treasurer in 1925. [1] By the beginning of 1934, the Albemarle County Board of Supervisors had eliminated the position of Treasurer and Hamm refused to leave office. [2]

Refusal to leave office

Hamm maintained he had the right to continue to hold office until the end of his term.

January 4, 1934 Statement on remaining in office

"In November 1931, I was elected Treasurer of the Albemarle County for the term of four years commencing January 1, 1932. I then qualified as Treasurer and executed bond with surety company in the penalty of $215,000 conditioned upon the performance of my duties as Treasurer. The office of Treasurer of a county is created by the Constitution of Virginia and that instrument provides that the term be four years."

"While the Constitution permits the General Assembly to provide a form of county organization and government different from that specified, the terms of the officers do not appear to be subject to that change. I have been advised that the Constitution contemplates that changes in form of government and organization shall take place at the end of the terms of constitutional officers and does not contemplate that offices may be vacated during their term. My term of office does not expire until December 31, 1935."

"As Treasurer, I am responsible for the collection and disbursement under proper authority of County funds. And my surety is responsible for performance of my duties as Treasurer. It has not seemed to me that I should abandon the office. Judge Grun has ruled, as I understand, that the term of the Board of Supervisors, elected in 1931, continues and that they must function. So I must function." [3]
