The Local Board of Building Code Appeals / Fire Prevention Code Appeals Board for Albemarle County is required by the Virginia Construction Code and the Virginia Maintenance Code, both require that a “Local Board of Building Code Appeals” be established by every locality to hear appeals of the decisions of Building Code and Building Maintenance Code Officials.

Overview/Duties

Hears cases where the owner of a building, the owner's agent or any person is aggrieved by the local building department's application of the Uniform Statewide Building Code (USBC) or its refusal to grant a modification to the provisions of the USBC. Requests for appeals must be submitted in writing within 30 calendar days of the receipt of the decision being appealed. The Virginia Construction Code and Virginia Maintenance Code (parts I and III, respectively, of the Uniform Statewide Building Code) both require that a “Local Board of Building Code Appeals” be established by every locality to hear appeals of the decisions of Building Code and Building Maintenance Code Officials.

Length of Term

Members serve terms of five years.

Frequency/Times for Meetings

Meetings are held whenever appeal applications are received. Times of meetings vary. Meetings are also held at least once a year to assure a duly constituted board, appoint officers as necessary and receive such training as may be appropriate.

Membership

The Board of Appeals shall consist of five members, and two alternate members appointed by the Board of County Supervisors. Employees or officials of the local government appointing the board shall not serve as board members. Members do not have to be residents of Albemarle County. Members are paid $45.00 per meeting, Albemarle Code § 2-1105).

Qualifications

Members are selected based on their ability to render fair and competent decisions regarding application of the USBC. To the extent possible, they will represent different fields relating to the construction industry. It is preferred that one member be an experienced builder, one be a registered design professional and one be a property manager.
